The terms of the sale of a puppy to the prospective owner are outlined as follows:

Puppy Purchase Agreement

THE PARTIES HERETO AGREE AS FOLLOWS:

1. SELLER AGREES TO transfer to BUYER one male/female (circle) German Shorthaired Pointer named ___________________________________ from AKC Litter # _________________________ (herein after "PUPPY") Sired by ________________________________________  whelped on _______ by ____________________________________________ in exchange for the payment by BUYER of an original purchase price of $________________ .

2. BUYER REPRESENTS AND WARRANTS that a good home, which is understood to be one with warm and dry bedding protected from weather and elements, affection, regular exercise, proper nutrition and medical care will be provided PUPPY for the entire time PUPPY is owned by or remains under the control of BUYER. If BUYER is unable or does not provide the PUPPY with a good home SELLER may hereunder require the return of PUPPY and appropriate AKC Registration Papers. Furthermore, BUYER will not transfer ownership of PUPPY to any animal shelter, "puppy mill" or laboratory and if at anytime BUYER is unable to provide PUPPY with a good home BUYER agrees to immediately notify SELLER, whereupon SELLER may assist BUYER with finding a new approved Owner for PUPPY.  In such case, the SELLER will provide no refund to the BUYER unless it is for the express purpose of assisting the BUYER in a sale to a new owner.  BUYER will receive all funds acquired from re-sale of PUPPY to a new owner less any costs incurred for transportation, veterinary bills, board, training, or other associated costs incurred in properly caring for PUPPY.  If PUPPY cannot be re-sold or a new home cannot be located, SELLER agrees to retain PUPPY but is not under any obligation to refund BUYER for the PUPPY.  SELLER will agree to pay for any transportation costs associated with the return of PUPPY from BUYER to SELLER and the mode of transportation for the return of PUPPY is at the discretion of SELLER.

3. SELLER REPRESENTS AND WARRANTS TO BUYER that PUPPY will be to BUYERS satisfaction and become a suitable personal hunting companion animal and will be free from significant genetic defects; and providing that BUYER has continuously maintained ownership and reasonable veterinary care of PUPPY, SELLER does hereby guarantee to refund to BUYER the amount of the original purchase price paid SELLER for any significant genetic defect the would prevent the PUPPY from becoming a suitable personal hunting companion for three years from the date of sale.  It is understood that the effects of non-genetic related diseases, maltreatment, neglect, or injury is not covered in this guarantee.  It is further understood that upon written notification to SELLER by BUYER stating the reason that BUYER is unsatisfied with PUPPY that SELLER shall, at SELLERS sole discretion, either require that: a) PUPPY shall, at SELLERS sole expense, be delivered with signed AKC Registration Papers to SELLER in otherwise well and uninjured condition, or b) PUPPY shall be euthanized by a Licensed Veterinarian, of BUYERS choice and at BUYERS sole expense, and written proof thereof be submitted to SELLER by said Licensed Veterinarian. Whereupon either the original purchase price or a replacement PUPPY will be promptly refunded to BUYER by SELLER. If however BUYER is desirous of keeping PUPPY which is substandard and SELLER agrees that PUPPY would be well served under such an arrangement, then SELLER may, at SELLERS sole discretion, refund one half of the original purchase price to BUYER upon receiving written verification from a Licensed Veterinarian, of BUYERS choice, that PUPPY has, at BUYERS sole expense, been spayed or neutered.

4.  SELLER REPRESENTS AND WARRANTS that all PUPPIES in litter will be registered with a full registration with the AKC and that the breeder will no conditions upon future breeding of PUPPY.  BUYER agrees to make every effort to test PUPPY under a North American Versatile Hunting Dog Association (NAVHDA) sanctioned Natural Ability (NA) Test prior to PUPPY reaching the age of 18 months at BUYERs sole expense. 

5. SELLER IS HEREBY RELEASED from any and all further liability to BUYER with regard to PUPPY and it is understood that no other conditions, guarantees or obligations concerning the sale of PUPPY shall ever apply; and furthermore, it is hereby expressly understood and agreed that from the date of this agreement BUYER accepts all liability for the actions of PUPPY and holds SELLER harmless with regard to any and all third parties.

IN WITNESS WHEREOF the parties hereto have caused this agreement to be duly signed and executed as of the last day and date below.

IT IS POSSIBLE THAT AFTER DISCUSSION BETWEEN THE PROSPECTIVE OWNER AND THE BREEDER THAT CHANGES CAN BE MADE TO THIS AGREEMENT IF BOTH PARTIES AGREE IN THE ENTIRITY, BUT THIS WOULD OCCUR ONLY UNDER RARE CIRCUMSTANCES.
